1. PARTIES
This Membership Agreement (“Agreement”) is entered into between SkyeRise Fitness LLC , a Missouri limited liability company (“Gym”), and the undersigned individual (“Member”).
I understand that participation in activities at SkyRise Fitness includes, but is not limited to, strength training, cardiovascular exercise, group fitness classes, use of fitness equipment, participation in programs, and use of childcare/babysitting areas. I acknowledge that these activities involve inherent risks, including but not limited to muscle strain, sprains, falls, equipment failure, illness, injury, or, in rare cases, permanent injury or death.
I knowingly and voluntarily assume all risks, both known and unknown, associated with participation for myself and/or my minor child.
RELEASE OF LIABILITY & NEGLIGENCE
To the fullest extent permitted by Missouri law, I hereby release, waive, and discharge SkyRise Fitness, its owners, officers, employees, contractors, volunteers, and agents from any and all claims, demands, causes of action, or liabilities, including those arising from the ordinary negligence of SkyRise Fitness, related to my participation or my child’s participation in any activities, programs, services, or use of the facilities.
This release applies to injuries, damages, or losses occurring on or off the premises, whether caused by negligence or otherwise, except for gross negligence or willful misconduct, which is not released under Missouri law.
MEDICAL ACKNOWLEDGMENT
I certify that I am physically capable of participating in fitness activities and that I have no known medical condition that would prevent safe participation, or I have received clearance from a medical professional. I agree to immediately stop participation if I experience pain, dizziness, or discomfort and to notify staff.
MINORS & CHILDCARE CONSENT
For participants under the age of 18, I certify that I am the parent or legal guardian and consent to my child’s participation in SkyRise Fitness activities, including supervised childcare/babysitting services. I assume full responsibility for my child’s participation and release SkyRise Fitness from liability to the fullest extent permitted by Missouri law.
MEDIA RELEASE
I grant SkyRise Fitness permission to photograph, record, or otherwise capture my likeness or my child’s likeness during participation and to use such media for marketing, advertising, and promotional purposes in print or digital formats without compensation.
GOVERNING LAW & VENUE
This agreement shall be governed by and construed in accordance with the laws of the State of Missouri. Any legal action arising out of this agreement shall be brought exclusively in a court of competent jurisdiction located in Missouri.
SEVERABILITY
If any portion of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
ACKNOWLEDGMENT & SIGNATURE
I acknowledge that I have read and understand this agreement, that I am waiving certain legal rights, including the right to sue for ordinary negligence, and that I sign this agreement voluntarily.
